DAC8 first crypto tax information exchange between EU member states

European Union Project

In September 2027 (the exact day is not specified), national tax authorities across the European Union are due to carry out the first exchange of crypto transaction data under the DAC8 directive. This first exchange covers the 2026 calendar year and is not tied to any specific coin.

What is happening

DAC8 is the eighth amendment to the EU's Directive on Administrative Cooperation. It requires crypto service providers to collect customer identities and transaction data and report them to national tax authorities. Those authorities then share the information with one another across member states.

The crypto reporting requirements took effect on January 1, 2026. The first cross-border exchange of the data gathered during that year is due by September 2027. Because 2026 is the first reporting period, this exchange will be the first time member states receive each other's records on crypto activity by their residents.

Implementation has not been uniform or uncontested. In France, crypto businesses Bull Bitcoin and Paymium challenged the decree implementing the reporting rules, arguing that centralizing detailed user data could create security risks. On September 17, the Council of State rejected their emergency request to suspend the decree, finding that urgency had not been established. The separate case seeking annulment of the decree remained pending at that time.

Why it matters

For holders, the exchange means that data reported by exchanges and other providers in one member state can reach the tax authority of the country where the investor is resident. This raises the importance of keeping accurate records of cost basis, transfers and conversions, especially for people who use several platforms or live in a different country from their provider.

The directive creates reporting obligations for service providers and does not by itself make every reported transfer taxable. National governments remain responsible for tax rules and enforcement, and those rules differ. France's parliament is discussing amendments that would tax conversions into fiat-pegged stablecoins from 2027, while a Greek draft bill proposes a 10% tax on crypto gains and would leave crypto-to-crypto swaps untaxed. All of these proposals remain subject to legislative approval. Traders active across borders may want to watch how national rules interact with the improved data sharing.
