Regulatory Deadline Regulation

South Korea virtual asset transfer business registration and FX reporting rules take effect

03 December 2026, Thursday
Online Location
USDT · USDC South Korea Ministry of Finance and Economy

On December 3, 2026, South Korea's amended Foreign Exchange Transactions Act is scheduled to take effect, introducing mandatory registration and Bank of Korea reporting for businesses that handle cross-border crypto transfers. The framework can touch stablecoin flows such as USDT and USDC, but it does not make them official payment instruments.

What is happening

The National Assembly passed the amendments on May 7, and they were promulgated on June 2. They create a new category of registered virtual asset transfer businesses covering services that move cryptocurrencies between South Korea and overseas markets. According to the Ministry of Finance and Economy's October 7 legislative notice, the draft enforcement rules also cover transfers between exchanges and private, unhosted wallets, because authorities consider them capable of producing similar cross-border effects. Public comments on the draft closed on October 26, after which it must go through regulatory and legislative reviews and Cabinet consideration.

Under the draft, qualifying operators must register with the finance ministry after completing existing virtual asset reporting obligations. They must connect their systems to the Bank of Korea's foreign exchange information network, keep records of relevant transfers, and maintain suitable computer systems. Each business office needs at least two qualified employees with two years of foreign exchange experience or government-approved training. No separate minimum equity capital requirement is proposed.

Registered operators would submit transaction data that could be shared with the National Tax Service, Korea Customs Service, Financial Supervisory Service and Korea Financial Intelligence Unit. The draft allows registration cancellation after a first qualifying violation and raises the maximum administrative surcharge in lieu of a four-month suspension to 100% of profits from the violation. Certain existing remittance and money exchange businesses have transitional arrangements until June 30, 2027.

Why it matters

Exchanges such as Upbit and Bithumb could face new obligations where their activities meet the definition of a virtual asset transfer business. Custody, brokerage and related transfer services may also be in scope, depending on how each firm operates. For users, the main change is closer monitoring of cross-border and private-wallet transfers, including those involving dollar stablecoins traded on Korean exchanges.

Some social media reports described the change as South Korea formally recognizing USDT and USDC as payment instruments. The ministry's announcement describes a registration and reporting framework, not a reclassification of these stablecoins, and it does not remove existing foreign exchange restrictions. No separate USDT trading limits, stablecoin transfer tax or exchange premium rules have been announced under this decree. Traders should watch the finalized enforcement decree for the exact scope and any changes to the draft.
