Regulatory Deadline Regulation

South Korea crypto gains tax takes effect

01 January 2027, Friday
Online Location
South Korea National Tax Service Project

⚠ The date is not confirmed yet and may change.

South Korea's long-deferred 22% tax on crypto gains is scheduled to start on January 1, 2027, applying to annual income above 2.5 million won. The date is tentative: petitions and competing bills could delay the start again, potentially to 2029.

What is happening

The tax was introduced through a 2020 revision of the Income Tax Act and has already been postponed three times. Under the current rules, a combined rate of 22 percent (other-income tax plus a local income-tax surcharge) would apply to annual income from the transfer or lending of digital assets that exceeds a basic deduction of 2.5 million won, roughly $1,800.

The National Tax Service is continuing preparations on the assumption that the January start date holds. It aims to finalize a draft notice by the end of October and issue formal guidance in November.

Pressure to revisit the schedule is growing. Two public petitions, one seeking repeal and another asking for a two-year delay, have each passed the 50,000-signature threshold that triggers legislative review. Democratic Party leader Kim Min-seok has called for a definitive decision by year's end. Lawmakers from both major parties have filed competing bills, and one Democratic proposal would tie the effective date to the first year of international information exchange under the OECD's Crypto-Asset Reporting Framework, which could move implementation to 2029.

The debate overlaps with work on the Digital Asset Basic Act. On October 22, 2026, Financial Services Commission Chairman Lee Eog-weon said inter-agency discussions on the law were in their final phase. An opposition lawmaker questioned taxing digital assets before the basic regulatory framework is complete, and Lee said the circumstances around virtual-asset taxation should be fully considered while diverse views are collected.

Why it matters

For holders and active traders in South Korea, the start date determines whether realized gains and lending income above the deduction become taxable from 2027. An estimated 11 million investors could be affected, so a delay or confirmation would shape how people plan their reporting and record-keeping.

Critics cite practical gaps: difficulty obtaining transaction records from overseas platforms and decentralized exchanges, no loss-carryforward provisions, and the time exchanges need to build compliant reporting systems. Whether these concerns lead to another postponement is the main open question. Because the date is not final, market participants should treat January 1, 2027 as the current legal schedule rather than a guaranteed start.
