South Korea 22% cryptocurrency income tax takes effect

01 January 2027, Friday
Online Location
South Korea Government Project

South Korea's 22% tax on qualifying cryptocurrency gains is scheduled to take effect on January 1, 2027, after three earlier postponements. The rule is not tied to a single coin and covers income from transferring or lending digital assets above an annual allowance of 2.5 million won.

What is happening

Under the framework, qualifying crypto income is treated as separately taxed other income under the Income Tax Act. The national rate is 20%, which becomes a combined 22% once local income tax is added. Annual gains and losses are netted, acquisition costs and transaction expenses are deducted, and a basic deduction of 2.5 million won is applied before the rate is charged. For assets held before the rules begin, the acquisition value will generally be set at the higher of the original cost or the market value immediately before implementation. The first tax returns, covering 2027 transactions, are expected in May 2028.

The National Tax Service (NTS) plans to publish detailed guidelines in November 2026. At an October 13 parliamentary audit, NTS Commissioner Lim Gwang-hyeon said preparations were underway and that the agency was working with exchanges and the Ministry of Finance and Economy. Tax officials are still reviewing how staking, airdrops, hard forks and decentralized finance (DeFi) activity should be treated. Lim indicated that treatment will depend on the economic nature of a transaction, and that airdrops and hard forks may fall within the framework in some cases. The guidance has not yet been issued, and no exact publication date has been announced.

The tax was first approved in 2020. Its start was pushed from 2022 to 2023, then to 2025, and the National Assembly approved a further two-year delay in December 2024. The government kept the January 2027 date in its 2026 tax reform plans. Proposals to delay the tax to 2030 or abolish it have been raised by the People Power Party, but none has changed the legal schedule. The date stands unless the National Assembly formally approves another postponement.

Why it matters

For holders and active traders in South Korea, the rule changes how gains are calculated and reported. Gains realized from 2027 onward will count toward a taxable total, so record-keeping of costs, fees and pre-2027 acquisition values becomes more important. Activities such as staking, airdrops and DeFi remain unclear until the NTS guidance appears, which makes the November publication a key point to follow.

Implementation also depends on data. Lawmakers have questioned whether domestic exchanges such as Upbit, Bithumb, Coinone, DigitalX and Gopax can produce consistent transaction records in time, and authorities acknowledge that overseas platforms and private wallets are hard to track. The OECD Crypto-Asset Reporting Framework is expected to help, though it will not capture every transaction.
