South Korea 22% crypto gains tax takes effect

01 January 2027, Friday
Online Location
South Korea Income Tax Act Project

South Korea's tax on crypto gains starts on January 1, 2027, applying a 22% rate to qualifying profits from digital assets above an annual deduction. The rules come under the Income Tax Act and are not tied to any specific coin.

What is happening

From January 1, 2027, income from transferring or lending digital assets will be taxed as separate other income. The national rate is 20%, which becomes 22% once local income tax is added. An annual basic deduction of 2.5 million won (about $1,870) applies before the tax is calculated.

Taxable income is worked out after subtracting acquisition costs and transaction expenses, and gains and losses for the year are combined before the deduction is applied. For assets bought before the rules begin, the acquisition value generally uses the higher of the original cost or the market value just before implementation. Returns for 2027 income are to be filed in May 2028, during the regular declaration period from May 1 to May 31.

The National Tax Service plans to publish guidelines in November. At a parliamentary audit on October 13, Commissioner Lim Gwang-hyeon said the agency is working with exchanges and the Ministry of Finance and Economy to prepare their systems, and that verification will begin with the returns filed in May 2028. Staking, airdrops and decentralized finance remain the most debated areas, and the treatment of an activity depends on whether it involves transferring or lending digital assets. Lawmakers also questioned whether the record-keeping of exchanges such as Upbit, Bithumb, Coinone, DigitalX and Gopax will be consistent enough, and transfers between private wallets remain the hardest to track.

Why it matters

The start of the tax sets a clear cost basis and reporting framework for South Korean crypto investors. Holders who bought before 2027 may benefit from keeping records of their original costs, since those figures feed into the special treatment of pre-existing assets. Active traders will need to account for combined annual gains and losses, fees and the 2.5 million won deduction.

The date is not yet fully settled in political terms. A petition against the tax has reached the 50,000 signatures needed for parliamentary consideration, and the People Power Party has proposed postponing the tax until January 2030. Authorities are also tightening oversight more broadly, having ordered website blocks on 27 unregistered overseas exchanges, including KuCoin, MEXC and BingX. The November guidelines and any parliamentary action on a delay are the main developments to watch.
