GENIUS Act expected general effective date

18 January 2027, Monday
Online Location
GENIUS Act (U.S. stablecoin framework) Project

⚠ The date is not confirmed yet and may change.

Treasury has identified January 18, 2027 as the expected general effective date of the GENIUS Act, the U.S. federal stablecoin framework. The date is tentative, because final implementing rules could trigger an earlier effective date.

What is happening

The GENIUS Act was enacted on July 18, 2025. Under Section 20, the Act generally takes effect on the earlier of two points: 18 months after enactment, or 120 days after the primary federal payment stablecoin regulators issue final implementing regulations. Counting 18 months from enactment gives January 18, 2027, which Treasury has named as the expected effective date. If final rules arrive early enough, the Act could take effect sooner.

A separate restriction on certain offers and sales begins on July 18, 2028. Treasury's August 2026 proposal expressly distinguishes the two dates, and the later one does not excuse businesses from existing law or from GENIUS Act provisions that take effect sooner.

Implementation is still a mix of enacted requirements and proposals. The OCC announced its principal proposal in February 2026, and the Federal Reserve announced proposals on September 24, 2026 covering supervised issuers, reserves, capital, risk management, custody and applications. An interim final rule effective September 30, 2026 set forms and procedures for state regulatory regime certifications, although acceptance of those certifications depends on information-collection approval and a Treasury notification.

Why it matters

The framework affects different businesses in different ways. Issuers face the central approval and prudential requirements, including identifiable reserves backing outstanding payment stablecoins at least one-to-one, limits on eligible reserve assets, redemption policies and reserve reporting. Exchanges, custodians and other intermediaries may have obligations for the stablecoins they offer even when another company issues them. Payment companies and businesses that hold or accept stablecoins need to review redemption access, custody, freezes and counterparty exposure.

For holders and traders, the practical questions are which tokens remain supported, on what terms they can be redeemed, and how platforms adjust their offerings as the rules take effect. Because the date is tentative and several rules are still proposals, it is worth watching for final regulations from the OCC and the Federal Reserve, any Treasury updates on the effective date, and platform announcements about supported stablecoins.
