GENIUS Act stablecoin law takes effect (latest date)
The US GENIUS Act, the federal law for stablecoins, takes effect no later than January 18, 2027, or earlier if final implementing rules arrive first. The law covers stablecoins, tokens designed to hold a fixed value in US dollars.
What is happening
The GENIUS Act has been law since July 18, 2025. The Senate adopted it on June 17, 2025 by 68 votes to 30, and the House followed on July 17, 2025 by 308 to 122. The law does not apply immediately: it takes effect eighteen months after signature, which puts the latest possible date at January 18, 2027. It could start sooner, 120 days after the regulators publish their final implementing rules.
Once it applies, stablecoin issuers will need a licence and must back their tokens fully with reserves. Issuers may also not pay holders interest.
The GENIUS Act is often confused with the CLARITY Act, a separate market-structure bill for Bitcoin, Ether, altcoins and trading platforms. That bill is not law: the Senate motion to open debate failed on September 15, 2026 by 49 votes to 50, and no new vote is scheduled as of October 22, 2026. The GENIUS Act is unaffected by that outcome and remains in force with its own timetable.
Why it matters
For stablecoin issuers, the effective date marks the point from which licensing, full reserve backing and the ban on paying interest to holders become binding. Issuers will have to meet these requirements to operate under the new federal framework.
For holders and traders, the interest ban is a notable detail: stablecoins issued under the law may not pay holders interest. The Senate version of the CLARITY Act goes further on this point, barring exchanges and other service providers from paying customers interest-like rewards purely for holding stablecoins, while rewards for genuine use would remain permitted. Banks and crypto exchanges have disputed that line for months. What to watch is whether the regulators publish final implementing rules early, since that would bring the start date forward from the January 2027 backstop.
