GAO investigation into CFTC workforce reduction begins

GAO investigation into CFTC workforce reduction begins

TBA December 2026, date TBC
Online Location
Government Accountability Office / CFTC Project

The U.S. Government Accountability Office is expected to formally initiate its probe into staffing cuts at the Commodity Futures Trading Commission in December 2026. The review concerns an agency that oversees crypto and prediction markets; no specific coins are tied to the event.

What is happening

The GAO, a congressional watchdog agency, is investigating the CFTC over its workforce reduction, according to a letter obtained by NPR. The probe follows a July request from Sen. Elizabeth Warren, D-Mass., for a federal investigation into the agency's staffing and fraud enforcement. The GAO is currently gathering staff and resources and will "initiate" the investigation in December. The CFTC did not directly comment on the probe.

The investigation is narrowly focused on staff reduction. By the end of 2025, the CFTC had 21% fewer employees than its previous 10-year average, based on U.S. Office of Personnel Management data, and the agency made nearly 80% fewer enforcement actions in 2025 than its annual average over the prior decade, according to its annual reports. As of July, the workforce was 16% below its decade average, roughly 100 staffers short, though staffing has risen slightly during 2026.

The CFTC said it is on track to hire about 100 employees in mission-critical areas by the end of 2026. Meanwhile its workload is growing: it approved six prediction markets in 2025 and another six this year, with 18 applications pending. Warren said Congress could use further tools, such as subpoenas and control over agency funding, but described the GAO review itself as limited to staffing.

Why it matters

The CFTC is a key U.S. regulator for derivatives, and its role in crypto and prediction markets is expanding. Former agency officials quoted in the reporting argue that reduced headcount limits both enforcement and the ability to write new rules and process market applications. The agency has also said it is moving ahead with its own crypto rulemaking after the Senate failed to advance a major crypto and banking bill this summer.

For market participants, the GAO review is a signal to watch how regulatory capacity, and not only regulatory policy, shapes oversight of crypto and prediction platforms. The probe is an oversight step and does not itself change any rules. Its scope, timeline and findings will become clearer once work begins.
