ESMA MiCA noncompliant stablecoin remediation deadline
⚠ The date is not confirmed yet and may change.
Under an opinion published by the European Securities and Markets Authority on October 8, 2026, MiCA-authorized crypto-asset service providers are expected to remediate pre-existing client exposure to noncompliant stablecoins within three months of publication. The deadline therefore falls around January 2027; the exact day has not been confirmed.
What is happening
On October 8, ESMA published an opinion on services involving stablecoins that do not comply with the Markets in Crypto-Assets Regulation (MiCA). The regulator's position is that authorized crypto-asset service providers (CASPs) should stop providing EU clients with services involving noncompliant asset-referenced tokens and e-money tokens. The opinion covers a wide range of activities, including operating a trading platform, exchange, order execution, advice, transfers, custody and portfolio management.
National regulators are expected to make sure providers do not maintain or facilitate new access to the affected stablecoins. ESMA says firms should put technical, contractual and organizational controls in place so that customers cannot acquire or increase exposure. Exposure that clients already hold should be remediated as soon as possible and no later than three months after publication. Limited services may continue temporarily where needed for liquidation, conversion, withdrawal, transfer or safekeeping.
The opinion gives an immediate supervisory position on how national authorities should treat currently noncompliant stablecoins. Because the three-month window runs from publication and the date is given only at month precision, the timing should be treated as tentative rather than a confirmed calendar day.
Why it matters
For MiCA-authorized providers, the opinion means reviewing every stablecoin available through their interfaces, including custody, routing and portfolio functions, and documenting the controls used to restrict additional exposure. A token being available outside the EU does not necessarily mean an EU-authorized provider may keep offering it to EU clients.
For holders and traders in the EU, the practical effect is on access. Services tied to non-MiCA-compliant stablecoins on authorized platforms may be limited to liquidation, conversion, withdrawal, transfer or safekeeping as the remediation period runs out. Users holding such tokens on regulated platforms may want to follow notices from their service provider about how and when positions will be handled.
