US midterm elections (affecting CLARITY Act's fate)

03 November 2026, Tuesday
Online Location
US Congress Project

On November 3, 2026, the United States elects the entire House of Representatives and about a third of the Senate. The result shapes whether the stalled CLARITY Act, the crypto market-structure bill, can still pass in the lame-duck session that follows.

What is happening

The CLARITY Act (H.R. 3633) would split oversight of crypto-assets between the SEC and the CFTC and require crypto exchanges to register at federal level. The House passed it on July 17, 2025 by 294 votes to 134. In the Senate, the motion to open debate failed on September 15, 2026 by 49 votes to 50, short of the 60 needed to overcome a filibuster. As of October 22, 2026, no new vote is scheduled.

The bill is not dead in formal terms. H.R. 3633 remains on the Senate's legislative calendar, and Senator Thom Tillis, who voted no on procedural grounds, filed a motion the same day that allows the failed vote to be reconsidered. Industry reports use the label "CLARITY Act 2.0" for a possible second attempt based on a revised substitute text from Senator Cynthia Lummis, who is not standing for re-election and has said she will keep campaigning for the law until she leaves.

After the November 3 elections, the lame-duck session runs until the 119th Congress ends on January 3, 2027. The Senate would have to pass the bill by then, and because its version differs from the House text, both chambers would have to agree on a common version. Otherwise the bill expires and the new Congress starts over. Disputes over ethics rules concerning the crypto businesses of the President and his family were central to the failed vote.

Why it matters

For holders and traders, the outcome determines whether the US gets a statutory framework for crypto-assets or continues to rely on regulators. The bill would define categories such as digital commodities, set rules for custody and exchange registration, and replace case-by-case court decisions on whether a token is a security. The Senate version also addresses interest-like rewards on stablecoins.

If the bill does not pass before the term ends, rule-making is likely to continue through the SEC and CFTC. On March 17, 2026, the SEC issued an interpretation, supplemented by CFTC guidance, that sorts crypto-assets into five groups and names 16 coins, including Bitcoin, Ether, XRP, Solana, Cardano, Dogecoin and Chainlink, as examples of digital commodities. The election outcome and the weeks after it are the window to watch for any renewed Senate action.
