Thailand SEC crypto ETF framework takes effect

16 October 2026, Friday
Online Location
BTC · ETH Thailand SEC

On October 16, 2026, the Thai Securities and Exchange Commission's framework for locally established crypto exchange-traded funds comes into force. It initially covers funds tracking Bitcoin (BTC) and Ether (ETH) that can be listed on the Stock Exchange of Thailand.

What is happening

The Thai SEC has issued rules that allow asset management companies to develop crypto ETFs for the domestic market. Under the framework, the funds must follow a passive strategy designed to track the price of the underlying cryptocurrency. They must keep average net exposure of at least 80% of net asset value to a single crypto asset over each accounting year, and the holdings must be safeguarded by custodians licensed by the Thai SEC. The products will be listed and traded exclusively on the Stock Exchange of Thailand.

The rules also include investor protections. Investors must receive information about how crypto ETFs work and acknowledge the risks before trading, and securities firms are prohibited from providing margin loans to finance purchases. Fund managers may outsource digital-asset investment management only to appropriately licensed digital-asset fund managers, and asset managers must demonstrate adequate operational systems, staffing and service-provider arrangements.

The framework also changes the position of local funds. Thai mutual funds and private funds will be able to invest in Thai-listed crypto ETFs, subject to existing investment limits; previously they were restricted to foreign crypto ETFs. During the initial phase, the regulator will restrict certain alternative products linked to foreign crypto ETFs and limit brokerage-facilitated access to overseas products for clients who are neither institutional investors nor ultra-high-net-worth investors.

Why it matters

The framework creates a regulated route to Bitcoin and Ether exposure through a conventional brokerage account, which may be attractive to investors who prefer traditional financial products over holding crypto directly or managing wallets. The Thai SEC has said the initiative is meant to expand investment choices, strengthen local financial-sector capabilities and support a more robust crypto ETF ecosystem. It also follows a broader international trend, with crypto ETF markets already developed in jurisdictions such as the United States and Hong Kong.

It is important to separate the rules from actual products. The October 16 date marks the start of the regulatory framework, not the launch of any fund. Asset managers must still meet the requirements, and no issuer, ticker or first trading date has been announced. The practical effect for BTC and ETH will depend on whether funds reach the market, how much investor demand they attract and how liquid the trading becomes. Market participants will be watching for the first filings and launch announcements from local asset managers.
