Regulatory Deadline Regulation

South Korea 22% crypto gains tax takes effect

01 January 2027, Friday
Online Location
South Korea Income Tax Act (virtual asset taxation) Project

South Korea's tax on crypto gains starts on January 1, 2027, applying a 22% rate to qualifying profits above an annual deduction. The rule covers digital assets in general rather than any specific coin.

What is happening

Under the Income Tax Act, qualifying income from transferring or lending digital assets will be taxed as separate other income. The national rate is 20%, which becomes 22% once local income tax is added. An annual basic deduction of 2.5 million won (about $1,870) applies before the tax is calculated.

Taxable income is worked out after acquisition costs and transaction expenses, and annual gains and losses are combined before the deduction is applied. For assets acquired before the rules begin, the acquisition value generally uses the higher of the original cost or the market value just before implementation, so investors who bought before 2027 are advised to keep records of their original costs. Returns for 2027 income are to be filed in May 2028, during the standard May 1 to May 31 declaration window.

On October 13, National Tax Service Commissioner Lim Gwang-hyeon told lawmakers during a parliamentary audit that crypto tax guidelines will be published in November. He said the agency is working with exchanges and the Ministry of Finance and Economy to prepare reporting systems. Staking, airdrops and decentralized finance remain the most debated areas, since their treatment depends on whether an activity counts as transferring or lending digital assets. Lawmakers also questioned whether exchanges such as Upbit, Bithumb, Coinone, DigitalX and Gopax can keep records consistent enough to meet the deadline. Transfers between private wallets are the hardest to track, because no domestic exchange holds customer data on them.

Why it matters

For holders and traders in South Korea, the start of the tax means realized gains above the deduction will become taxable and need to be reported. Record-keeping of purchase costs, particularly for assets bought before 2027, will determine how gains are calculated. The upcoming guidance may clarify how staking, airdrops and DeFi income are treated, which is currently uncertain.

The timeline is not free of political uncertainty. Opposition continues: a parliamentary petition has reached the 50,000 signatures needed for consideration, and the People Power Party has proposed postponing the tax to January 2030. The current schedule stands as confirmed, but these efforts are worth following. Regulators have also ordered website blocks on 27 unregistered overseas exchanges, including KuCoin, MEXC and BingX.
