South Korea 22% crypto gains tax start date

01 January 2027, Friday
Online Location
South Korea Government / National Tax Service Project

⚠ The date is not confirmed yet and may change.

South Korea's 22% tax on annual cryptocurrency gains is legally scheduled to take effect on January 1, 2027. The date is tentative, because the presidential office now backs a delay to 2029 that Parliament has yet to approve. No specific coins are named, as the tax applies to gains from selling or lending crypto assets in general.

What is happening

The tax was introduced through amendments to the Income Tax Act in 2020, with an original start date of January 2022. Lawmakers have since pushed it back to 2023, then 2025, and finally January 2027. Another postponement would be the fourth delay. Under the current framework, a combined 22% rate (20% national income tax plus 2% local income tax) applies to annual profits above a 2.5 million won allowance. For example, an investor with 5 million won in qualifying gains would pay 550,000 won.

According to an October 25 report, a presidential office official said discussions have moved toward delaying implementation because the government is not fully prepared to collect the tax. Cited concerns include difficulty obtaining transaction data from overseas exchanges and privately controlled wallets, fairness between domestic and foreign platform users, and the position of younger investors. South Korea expects to begin international information exchange under the OECD's Crypto-Asset Reporting Framework in 2027, but the presidential office pointed to the United States' planned participation from 2029.

The ruling Democratic Party has already introduced a bill proposing a January 2029 start. Opposition People Power Party lawmakers have also supported postponement, though some favor a later date or outright repeal. Consultations between the presidential office, the government and the ruling party are expected after October's parliamentary audit, and lawmakers could consider changes during the November tax law review. Until an amendment passes, the January 1, 2027 date remains in force.

Why it matters

For holders and traders on domestic platforms such as Upbit and Bithumb, the outcome determines whether gains realized in 2027 become taxable. A delay would postpone that obligation, while the current schedule would bring the tax into effect next year. Industry representatives have warned that uneven reporting rules could push trading activity toward foreign services.

Open questions remain about how income from staking, airdrops and decentralized finance would be calculated, and tax reporting guidelines were expected in November. The presidential office has not published an estimate of how a delay would affect tax revenue, trading volumes or collection costs.
