What is happening

It also replaces the term "crypto asset" with "digital commodity," a wording borrowed from an existing Nasdaq rule for commodity trusts, which touches on the long-unresolved question of whether such assets fall under SEC or CFTC jurisdiction.

Under SEC procedure, the regulator has three options at the end of the statutory review period: approve the filing, reject it, or institute proceedings that extend the review by up to 90 days from the original Federal Register publication date. The latter route is considered the most likely outcome for a filing of this scope, meaning no final decision is expected to fall exactly on the 45-day mark.

Why it matters

If adopted, the rule would streamline how options on crypto ETFs reach US exchanges, potentially deepening options markets for funds tied to BTC, ETH, SOL, XRP and LINK. A deeper options market gives market makers more tools to hedge their positions, which can affect the bid-ask spreads that holders and traders of related crypto ETFs and ETPs experience, including in markets outside the US.
