OCC GENIUS Act stablecoin final rule takes effect

18 January 2027, Monday
Online Location
Office of the Comptroller of the Currency Project

On January 18, 2027, the final rule from the Office of the Comptroller of the Currency implementing key provisions of the GENIUS Act is set to take effect. It covers permitted payment-stablecoin issuers, certain foreign issuers and some custody activities at OCC-supervised institutions, and no specific coins are named.

What is happening

The OCC announced the final rule in a release dated October 21, 2026. The rule and its relevant provisions take effect on January 18, 2027. It applies to permitted payment-stablecoin issuers under the agency's jurisdiction, certain foreign issuers and some custody activities carried out by OCC-supervised institutions.

According to the regulator, its standards address reserve backing, redemption obligations and risk management. The OCC says it reviewed extensive public feedback before finalizing the text.

The rule does not settle every federal requirement. Bank Secrecy Act, anti-money-laundering and sanctions regulations are reserved for a separate Treasury-coordinated rulemaking. The OCC has also said it will announce separately when applications and waivers can be processed, so the effective date does not mean that any issuer is already authorized.

Why it matters

A defined rulebook helps market participants distinguish regulated payment instruments from products that only claim to track the dollar. It also raises compliance costs, since maintaining reserves, meeting redemptions and handling supervision require ongoing operational capacity. For holders and traders, authorization, reserve custody, supervisory reporting and customer eligibility can influence where a stablecoin is available and which institutions may handle it, even though no smart-contract code changes.

The effect on markets depends on implementation rather than on the headline date. Regulated access is not an investment recommendation, and a supervised service can still face market risk, operational failures or limits on the protections available to holders.

Key details

Worth watching before the start date are the application procedures, any interagency guidance and how issuers demonstrate reserve quality, redemption processes and compliance. Official implementation updates and measurable outcomes will be more informative than the announcement itself.
