Thailand SEC crypto ETF rules take effect
New regulations from the Thailand Securities and Exchange Commission establishing a framework for crypto exchange-traded funds are set to take effect on October 16, 2026. In the initial phase, only Bitcoin (BTC) and Ether (ETH) ETFs will be permitted.
What is happening
The Thai SEC issued the regulations on October 8, creating a framework for digital currency ETFs in the country. The regulator said the rules are intended to broaden investment opportunities for investors, strengthen the capabilities of business operators and promote the crypto ETF ecosystem under an appropriate investor protection framework.
Crypto ETFs must follow the regulatory framework that applies to standard ETFs, plus additional safeguards. A fund must keep average net exposure to a single digital asset of at least 80% of net asset value over each accounting year. Funds must be listed and traded exclusively on the Stock Exchange of Thailand (SET) and held only by digital asset custodians regulated by the SEC. Asset managers must show adequate organizational readiness, including personnel, operational systems and arrangements with service providers.
The rules also add investor protection measures, such as mandatory education on the product's characteristics and risks and a requirement that investors acknowledge and confirm their understanding of those risks before trading. Mutual funds and private funds, which could previously invest only in foreign crypto ETFs, will be allowed to invest in Thai ones, subject to existing investment limits. During the initial phase, the SEC will prohibit alternative products referencing foreign crypto ETFs, such as depository receipts, and will bar securities companies from facilitating investment in foreign crypto ETFs for clients who are neither institutional nor ultra-high-net-worth investors.
Why it matters
The framework creates a regulated, exchange-listed route to BTC and ETH exposure in Thailand, the largest crypto adopter in Southeast Asia. For local investors, it offers a way to gain exposure through a traditional securities account rather than directly holding the assets. For asset managers, it sets out the conditions required to launch such products.
For traders and holders, the practical effects will depend on which funds are actually launched and when. The rules open the door to products but do not themselves list any fund. The restriction on foreign ETF-linked products and the SEC's ability to prescribe eligible crypto assets are also worth following, since the regulator has indicated that only BTC and ETH are allowed at the start.
