Thailand SEC crypto ETF framework takes effect
On October 16, 2026, the crypto ETF framework issued by the Securities and Exchange Commission of Thailand (SEC Thailand) becomes effective, allowing passively managed exchange-traded funds that track bitcoin (BTC) and ether (ETH). The date marks the start of the regulatory regime, not the first day of ETF trading.
What is happening
SEC Thailand has issued 11 rules covering the establishment of crypto ETFs, digital asset investment management, custody, fund oversight and investor protection. In the initial phase, only bitcoin and ether may serve as reference assets. Other assets could be added later, with the regulator considering liquidity, market acceptance, network security and investor protection.
The funds must be passively managed and track the price of the underlying crypto asset. Each product must hold an average net exposure of at least 80% of its net asset value to a single crypto asset over one fiscal year. Thai crypto ETFs may trade only on the Stock Exchange of Thailand (SET), and the underlying assets must be kept with a digital asset custodian supervised by the regulator.
Other conditions apply. Securities companies may not offer margin loans for buying crypto ETFs, and investors must receive an explanation of the product's characteristics and risks and confirm their understanding before trading. Mutual funds and private funds may now invest in domestic crypto ETFs; previously they could only hold foreign ones, within applicable limits. For now, alternative products referencing foreign crypto ETFs, including depositary receipts, are not permitted, and brokers cannot offer foreign crypto ETFs to retail clients who are not institutional or high-net-worth investors.
Issuers still have to complete fund registration, obtain product approvals, arrange custody and secure a SET listing before any ETF can start trading. The framework follows public consultations on the principles in April-May 2026 and on draft rules in August-September, and the regulator said most respondents supported the approach that was finalized.
Why it matters
The framework creates a regulated route to bitcoin and ether exposure through existing brokerage accounts on a domestic exchange. Binance TH CEO Nirun Fuwattananukul noted that this can remove a barrier for investors reluctant to open exchange accounts or manage wallets. Bitkub Group co-founder Attakrit Chimphlapibul said the rules open opportunities for investment managers, custody providers and local financial firms, while stressing that the outcome depends on operator readiness and investor response.
For holders and traders, the practical points to watch are issuer announcements, product approvals and SET listing dates. Fuwattananukul added that the scale of fund flows will depend on competitive fees, how accurately products track the underlying asset, and investor education. Until the first funds are approved and listed, the effective date changes the rules but not yet the available products.
